Public Notice of Decisions on Proposed Changes
to District Plan - Energy and Biodiversity
Clause 5 of First Schedule, Resource Management Act 1991
Following hearings on 2 and 3 July 2012 (Biodiversity) and
13 and 14 August 2012 (Energy), the decisions of the Hearing
Panels were adopted by the Clutha District Council on
13 December 2012. Pursuant to Section 86B of the Resource
Management Act 1991 the rules will have legal effect from
22 December 2012.
The decisions have confirmed the plan changes to update
the District Plan as follows:
• Plan Change 23: Delete and replace the entire Section 3.4
(Energy) to establish new objectives, policies and rules to
deal with new and existing energy facilities, associated
activities, and investigation and assessment works.
The new section is based on public feedback to an Issues
and Options consultation document, and consultation with
the energy sector and other stakeholders. It also addresses
the requirements of the National Policy Statement on
Renewable Electricity Generation.
• Plan Change 24: Amendments and additions to Definitions
in the District Plan, required to give effect to Proposed Plan
• Plan Change 25: Addition to the District Plan Schedules
to provide for Scheduled Electricity Generation and
• Plan Change 26: Amendments to Section 3.5 (Heritage),
Section 4.1.4 (Rural Resource Area Rules) and Section
4.2.4 (Coastal Resource Area Rules) to increase the level of
control on clearance, selective removal and modification of
indigenous vegetation, while still allowing some clearance
and modification for certain specified purposes.
• Plan Change 27: Amendments and additions to Definitions
in the District Plan, required to give effect to Proposed Plan
The decision results in some changes to the provisions as
notified in November 2011.
Pursuant to Clause 14(1) of the First Schedule to the Resource
Management Act 1991 any person who made a submission
on the Plan Changes may appeal to the Environment Court.
Any appeal must be in the prescribed form and lodged with
the Environment Court within 30 working days of service of
the attached notice.

Balclutha Public Library, 23 John Street, Balclutha; Lawrence
Service Centre, 5 Peel Street, Lawrence; Milton Service
Centre, 124-126 Union Street, Milton; and Tapanui Service
Centre, Suffolk Street, Tapanui, or on Council's website
www.cluthadc.govt.nz, and can be provided upon request.

6 egg whites
1 tsp white vinegar
1 tsp vanilla essence
1 ½ cups castor sugar 1 tblsp cornflour
Line every second hole of two 12 hole muffin pans with paper cases. Beat egg
whites, vinegar and essence in a large bowl until soft peaks form. Gradually add
sugar beating until sugar is dissolved after each addition. Fold in cornflour. Spoon
mixture evenly into paper cases making sure meringue does not touch the sides of
muffin pan. Cook in very slow oven, 120c for about 1 ¼ hours or until meringues
are dry. Stand meringues in pans for 5 minutes then gently remove from the pan.
Peel away paper cases and cool.FILLING
1 x 300ml bottle of cream
1 tblsp castor sugar ½ tsp vanilla essence
Punnet strawberries sliced ½ cup passionfruit pulp
Beat cream, sugar and essence in a small bowl until soft peaks form.
Slice the tops off meringues, fill with cream mixture, strawberries and
passionfruit pulp then replace the meringue tops

ADVERTISING TERMS AND
In accepting an advertisement (including a notice) for publication,
and in publishing it we are doing so in consideration of and relying
on the advertisers express warranty, the truth of which is essential:
a. That the advertisement does not contain anything that is
misleading or deceptive or likely to mislead or deceive or which
otherwise breaches the Fair Trading Act 1986. That is defamatory or
indecent or which otherwise offends against generally accepted
That infringes a copyright or trademark or otherwise infringes any
intellectual or industrial property rights.
That breaches any provision of any statute, regulation, by-law or
other rule or law, and
b. That the advertisement complies in every way with the
Advertising Codes of Practice issued by the Advertising Standards
Authority Inc. (ASA) and with every other code or industry standard
relating to advertising in New Zealand, and
c. Publication of the advertisement will not give rise to any liability
on our part or in a claim being made against us.
2. The advertiser agrees to indemnify us against all losses or costs
arising directly or indirectly from any breach of those warranties by
the advertiser and from any costs incurred in our making corrections
or amendments in accordance with the terms that follow.
3. By supplying or placing an advertisement for publication the
advertiser grants us a perpetual, royalty free license to reproduce the
advertisement in any print or electronic advertising media we offer
advertisers now or in the future.
4. Where the advertiser utilises any aspect of our creative services in
the design or production of an advertisement (including photo-
graphic or design work) the advertiser acknowledges that we own the
copyright in such work and that such work is not work for which a
commissioning payment has been made or agreed.
5. We may refuse to publish, or withdraw an advertisement from
publication without having to give a reason.
6. We may publish the advertisement on the next available day if
there is an error delay in publication of the advertising as booked.
7. We may correct or amend advertising to conform to style or for
other genuine reason as long as we do so using reasonable care.
8. We may take orders for advertising in specific spaces (space
orders). The space may be used only by the advertiser for advertising
of the advertisers usual business and may not be transferred by the
advertiser to another person.
9. The guarantees contained in The Consumer Guarantees Act 1993
are excluded where the advertiser acquires, or holds himself out as
acquiring, goods or services from us for the purpose of a business.
10. The advertiser must tell us as soon as possible if there is an error
or omission in any advertisement the advertiser has placed. We will
not be liable for any indirect or consequential loss (which includes
loss of revenue or profit) from an error or omission or failure to
publish and if we are found to have any direct liability for any
circumstance that liability is limited to the cost of the space of the
11. To cancel an advertisement a cancellation number must be
obtained from us.
12. The charge for an advertisement will be in accordance with the
published rate card applying at the time for the publication, unless
we agree otherwise in writing. Rate card adjustments will apply to
space orders with effect from advertising appearing 28 days after the
rate adjustment is published on our rate card. Rates for space orders
apply for the whole space and are not reduced if the whole space is
13. Advertising placed by advertisers who are not New Zealand
residents will be zero-rates for GST purposes. GST will be applied at
the standard rate to advertising placed by non-resident agents acting
for New Zealand resident principals.
14. If payment for advertising is not made by due date (which is the
20th of the month following invoice. unless we specify otherwise ) the
advertiser will be liable for interest at market rates and all costs of
recovery, commissions and collection fees.
